In terms of quality of intellectual property creation: 54,100 patents were authorized throughout the year
Fan Junan introduced that Chongqing will have 54,100 authorized patents in 2023, including 13,600 invention patents, 34,100 utility model patents, and 6,400 design patents; the number of invention patents per 10,000 people will reach 19.98, an increase from 2022 23.79%, the number of high-value invention patents per 10,000 people reached 7.15, an increase of 30.47% compared with 2022; there were 528 international patent (PCT) applications, an increase of 17.07% compared with 2022. The total number of valid registered trademarks is 866,600, an increase of 7.44% compared with 2022. The total number of geographical indications is 298. 150,900 ordinary works were registered throughout the year. 11,300 technology contracts were identified and registered, with a turnover of 86.51 billion yuan, including 3,884 intellectual property contracts, with a turnover of 17.257 billion yuan. The annual patent and trademark pledge financing was 1.898 billion yuan, an increase of 16.87% compared with 2022. New knowledge value credit loans amounted to 3.431 billion yuan, benefiting 1,983 enterprises. A total of 29,900 notarization matters involving intellectual property protection have been handled, and a total of more than 106 million certificates have been stored in the “Intellectual Property Protection Platform of the Bank’s Notarization Chain”.
In terms of intellectual property protection mechanisms: legal protection and institutional supply continue to be strengthened
The “Chongqing Patent Promotion and Protection Regulations” have been revised and will come into effect on September 1, 2023. The “Chongqing Municipal Intellectual Property Protection Regulations (Enacted)” and “Chongqing Municipal Geographical Indications Regulations (Enacted)” have been included in the legislative plan by the Municipal People’s Congress and the Municipal Government. The Municipal Intellectual Property Protection Joint Conference Office issued the “2023 Chongqing Strengthening Intellectual Property Protection Promotion Plan”, identifying 44 annual key tasks and coordinating and promoting the city’s intellectual property protection work. There are 426 “contact points for comprehensive protection of intellectual property rights” in the city. The Chongqing Intellectual Property Protection Center was approved to build a local branch center of the National Overseas Intellectual Property Dispute Response Guidance Center. Eight new municipal-level overseas intellectual property dispute response guidance workstations were established, serving a total of 856 enterprises. Rongchang District and Jiangjin District were approved as the second batch of national pilot cities for building an intellectual property powerhouse.
In terms of intellectual property protection: full-chain protection is further strengthened
The city’s intellectual property management department handled 789 cases of patent infringement disputes, and opened and investigated 1,433 cases of patent, trademark and geographical indication violations, with a case value of 19.54 million yuan. The city’s copyright administrative law enforcement departments dispatched a total of 79,800 law enforcement officers, inspected 28,800 market entities, and investigated and dealt with 139 infringement and piracy cases.
The Municipal Agriculture and Rural Affairs Commission carried out special rectification of the citrus seedling market and cleaned up illegal varieties, and investigated and dealt with 1 case of variety infringement. The Municipal Forestry Bureau launched a special campaign to crack down on the production and sale of fake and inferior seedlings and protect the rights of new plant varieties. It inspected 412 nurseries and afforestation plots and 366 production and operation enterprises, handled 38 cases of forest and grass seedlings, and fined and confiscated 682,600 yuan. Chongqing Customs continued to maintain a high-pressure posture in cracking down on infringement, detaining a total of 1,896 batches of infringing goods and 22,700 pieces of infringing goods throughout the year.
The city’s public security organs launched the “Kunlun 2023” special operation and uncovered a total of 401 criminal cases of infringement of intellectual property rights and the production and sale of counterfeit and shoddy goods. The city’s courts accepted a total of 16,300 intellectual property dispute cases of first and second instance, and concluded 15,300 cases. The innovative intellectual property small claims trial model of the Chongqing Liangjiang New Area (Free Trade Zone) Court was selected into the “Second Batch of 30 Typical Cases in Building a Powerful Intellectual Property Nation”. The city’s procuratorial organs handled a total of 348 intellectual property cases of various types, recovering more than 12.51 million yuan in losses; they handled 170 intellectual property criminal cases, and prosecuted 92 cases and 210 people.
Sichuan and Chongqing jointly launched the “Made in Sichuan and Chongqing” joint intellectual property law enforcement action, and a total of 678 illegal cases were filed and investigated, with a case value of approximately 22.56 million yuan and a fine of approximately 12.06 million yuan.
